Introduction

These Terms of Service (“Terms”) govern your use of the Nume Notes iOS app (“Nume Notes”, “the App”). By using the App, you agree to these Terms.

  1. Who We Are

Nume Notes is provided by Eesa Patel (“we”, “us”).

  1. Eligibility & Accounts

The App may be used by children (e.g., 4+). If you are a parent or guardian, you are responsible for your child’s use of the App, including purchases, where permitted by applicable law.

You may use the App with an anonymous account and/or sign in with Apple or Google, depending on availability.

  1. Your Content & iCloud Storage

Your note content and most app data are stored in your iCloud (CloudKit) under your Apple ID. We do not store your note body/content on our servers.

You are responsible for your content, including ensuring you have rights to upload/store it in iCloud and to submit it for AI processing when you choose to use AI features.

  1. AI Features

If you use AI features, the App may send the inputs you provide (text, images, voice transcripts, links) to third-party AI providers (currently Google Gemini and OpenAI) to generate outputs.

AI outputs may be inaccurate or incomplete. You are responsible for how you use AI-generated content.

  1. AI Credits

All AI features require AI Credits. AI Credits may be obtained through:

  • One-time consumable purchases (credit packs)

  • Promotions/promo codes

  • Onboarding or gifted credits (when offered)

  • Subscription benefits (when offered)

AI Credits have no cash value, are non-transferable (unless explicitly supported by a gift feature), and may not be resold.

  1. Subscriptions (Auto-Renewable)

Nume Notes may offer auto-renewable subscriptions. Subscriptions are billed through your Apple ID and are subject to Apple’s policies.

  • Auto-renewal: Subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.

  • Manage / cancel: You can manage or cancel subscriptions in iOS at Settings → Apple ID → Subscriptions.

  • Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.

  • Refunds: Refund requests are handled by Apple. See Apple’s refund/support processes.

  1. Purchases (Consumables) & RevenueCat

Credit pack purchases are handled via Apple In‑App Purchase and managed with RevenueCat for entitlement/purchase orchestration. Payment details are processed by Apple.

  1. Acceptable Use

You agree not to:

  • Misuse the App (e.g., interfere with normal operation, attempt to bypass credit limits or paywalls)

  • Use the App for unlawful, harmful, or abusive purposes,

  • Reverse engineer or attempt to extract proprietary code (except as permitted by law).

We may suspend or terminate access if we reasonably believe you violated these Terms or engaged in abuse/fraud.

  1. Intellectual property

The App, its design, and its code are owned by us and/or our licensors and are protected by applicable laws. You receive a personal, non-exclusive, non-transferable license to use the App for its intended purpose.

  1. Third-Party Services

The App uses third-party services (including Apple, Firebase, RevenueCat, and AI providers). Your use of those services may be subject to their terms and policies.

  1. Privacy

Our privacy practices are described in our Privacy Policy: www.numenotes.com/legals/privacy.

  1. Disclaimer of Warranties

The App is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free.

  1. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill. Our total liability for any claim related to the App is limited to the amount you paid (if any) for the App or services in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the extent permitted by law.

  1. Termination

You may stop using the App at any time. We may suspend or terminate access to the App if required by law or if you materially breach these Terms.

  1. 1 Account Deletion & Data Retention

If you use the App’s Delete Account feature, we will delete most server-side data associated with your account that is not required to keep the service running or to meet legal obligations.

However, because Nume Notes offers paid purchases, we may retain transactional records (such as purchase and subscription records) linked to your anonymous identifier for legal, accounting, tax, audit, and fraud-prevention purposes (for example, handling refunds and chargebacks). We may also keep a record that your account was deleted (identifier + deletion timestamp).

  1. Changes To These Terms

We may update these Terms from time to time. We will update the “Effective date” above when changes are made. Continued use of the App after changes means you accept the updated Terms.
